    Please follow these simple steps to secure your hire room: Hire room

    1. Complete the Customer Details Form below.

    2. Read and acknowledge the Hire Agreement Form below.

    3. Read and acknowledge the Room Return Cleaning agreement below.

    4. Complete and submit the Ezidebit* Form sent to your email.

    We’ll set you up as a client and follow up with an invoice.

    Once your invoice is paid & Ezidebit* form complete we’ll secure your room and book transport.

    We’ll then contact you with your delivery details.

    *For those use Ezidebit, payment & processing system, not for those paying on invoice.

    FEES & CHARGES

    To keep things simple, hire payments are structured one week, fortnight, or full month in advance, depending on your hire period. Transport (each way), return service, and sanitisation are always payable upfront by the Hirer.

    YOUR FIRST INVOICE

    Your first invoice will include the following charges:

    1. Delivery transport – charged at time of booking, non-refundable

    2. Collection transport – charged upfront, applied at end of hire

    3. Return service & sanitisation – charged upfront, completed upon unit collection

    4. First hire cycle – one week, fortnight, or full month paid in advance

    EZIDEBIT – As simple as set and forget.

    Ezidebit (Automated Payments) – Payments are processed automatically via Ezidebit on your nominated billing date. Transport, return service, and sanitisation fees are collected upfront and held as a non-refundable commitment at commencement. (T&Cs apply)

    Invoice – Invoiced weekly, fortnightly, or monthly in line with your hire period. A refundable bond equivalent to four (4) weeks’ hire is required upfront, inclusive of all applicable charges. (T&Cs apply)

    OTHER – As agreed in writing with Keep It Cool prior to commencement. (T&Cs apply)

    ROOM RETURN CLEANING CHARGES

    I acknowledge that the hired room must be returned clean, tidy, and sanitised – both inside and outside – in the same condition it was provided. A cleaning fee of up to $500 + GST will be charged if the room is returned in a condition other than agreed, or where cleaning beyond Keep It Cool Sydney’s standard practices is required.

    Examples include but are not limited to: Product stains, Mildew, product odours. Garbage or debris left inside, around or on roof of the unit.

    TERMS & CONDITIONS

    INSURANCE & LIABILITIES LIES WITH THE HIRER.

    WE DO NOT COVER ANY LOST OF GOODS DUE TO ROOM BREAKDOWN.

    HIRER IS ADVISED TO UNDERTAKE INSURANCE ON THE ROOM, SHELVING & STOCK HELD WITHIN THE ROOM AS NO CLAIMS WILL BE CONSIDERED FOR LOSS OF PRODUCT.
    (CLAUSE NO 9 IN CONDITIONS OF HIRE AGREEMENT).

    HIRER IS RESPONSIBLE THAT THE ROOM IS OPERATING CORRECTLY & AT CORRECT TEMPERATURE.

    HIRER IS TO NOTIFY KEEP IT COOL SYDNEY IMMEDIATELY OF ANY MALFUNCTIONS WITH THE ROOM.

    IN THE EVENT OF IMPROPER USE OF THE ROOM, ANY CHARGES WILL BE CHARGED TO THE HIRER AT COMMERCIAL RATES INCLUDING CALL OUTS, REPAIRS & PARTS.

    PAYMENT OF AN INVOICE BY THE HIRER UNDERTAKES THE STANDARD TERMS AND CONDITIONS OF HIRE, WHICH ARE AVAILABLE ON REQUEST.

    IN CONSIDERATION OF THE RENTAL OF PROPERTY FROM KEEP IT COOL SYDNEY,

    I THE HIRER AGREE TO INDEMNIFY KEEP IT COOL SYDNEY AGAINST ALL CLAIMS, SUITS, DEMANDS, JUDGEMENTS, ACTIONS, COSTS AND EXPENSES ARISING FROM, OR IN CONNECTION WITH, ANY DAMAGES OR INJURY TO PERSONS, OR PROPERTY RESULTING FROM THE POSSESSION, USE OR OPERATION OF THIS PROPERTY BY ME THE HIRER.

    SUPPLIED KEYS ARE TO BE RETURNED – REPLACEMENT KEYS INCURS COSTS.

    ALL SHELVING MUST BE RETURNED WITH ROOM – LOST, BROKEN OR MISSING SHELVING WILL INCUR COST TO HIRER.

    IF THERE IS A BREAKDOWN OR FAILURE OF THE EQUIPMENT THE HIRER SHALL NOTIFY THE OWNER IMMEDIATELY FOR THE APPROPRIATE ACTION TO BE TAKEN.

    FAILURE TO INFORM MAY RESULT IN UNNECESSARY COST TO HIRER.

    ROOM TO BE RETURNED CLEAN, TIDY & IN GOOD WORKING ORDER.

    ANY BONDS REFUNDED AFTER ROOM RETURNED & INSPECTED.

    HIRE CONSIDERED ENDED UPON ROOM BEING RETURNED TO DEPOT BY TRANSPORT

    WE REQUIRE

    (14) DAYS’ NOTICE REQUIRED TO END A ROOM HIRE IF HIRE IS OVER (3) MONTHS.

    (7) DAYS’ NOTICE TO END A ROOM HIRE IF HIRE IS UNDER (3) MONTHS.

    Hire Agreement

    Please read carefully our agreement

    1. In this Agreement:

      1. “owner” means, Keep It Cool Sydney PTY LTD 72 163 584 012 for or on whose behalf this agreement is entered into and its respective servants, agents or assigns.

      2. “hirer” means the person named in the Schedule and any person whose agent signs this agreement.

      3. “unit” means the unit described in the Schedule, or its replacement including its components, spare parts and associated equipment.

      4. “period” means the period of hire set out in the Schedule and upon expiry of the period stipulated if the hirer remains in possession of the unit with the consent of the owner either party may terminate this Agreement by giving to the other one month’s notice in writing.

      5. “hire charge” means the total of owners’ usual hire fee for the period and any other cost of expense incurred by the owner arising out of the hire of the unit to the hirer.

      6. “GST” means tax, levy, duty of charge together with any interest penalty imposed by or under the Goods & Services Tax Act 1998.

    2. The owner hereby hires the unit to the hirer and the hirer shall take on hire of the unit as a Bailee for the period upon the terms and conditions stated.

    3. The hirer acknowledges:

      1. that the unit is clean and in good repair at the commencement of the period and the hirer undertakes to return the unit in the same condition.

      2. that in entering into this agreement the owner has relied on the truth and accuracy of the particulars provided by the hirer and set out in the Schedule.

    4. The hirer warrants that the particulars provided but the hirer and appearing in the Schedule are true and correct.

    5. The hirer agrees:

      1. to pay to the owner upon demand the hire charge for the period for the hire of the unit;

      2. to return the unit to its owner;

      3. to reimburse the owner for the cost of any lost, stolen of mislaid components or equipment relating to the unit;

      4. to take out a policy of insurance for breakage, fire and theft noting the interests of the owner in the unit and provide to the owner a copy of such policy.

    6. The hirer undertakes:

      1. that the hirer will not, without the written consent of the owner, part with possession of the unit or authorise permit or offer the unit to be used by any person other than the hirer or the joint hirer.

      2. to use the unit only in accordance with the manufacturer’s specifications;

      3. to reimburse the owner for, and indemnify the owner against, any loss (including legal fees) incurred by the owner arising out of a breach by the hirer of any of the hirer’s obligations.

    7. The hirer authorizes the owner to complete on the hirer’s behalf any documentation for the purposes of the hirer making payment to the owner through a credit card or debit card system or other payment facility made available by the owner and accepted by the hirer.

    8. The owner shall have the right at any time during the period of hiring to repossess the unit at the owner’s absolute discretion and without giving to the hirer any reason for so doing, and for that purpose to enter personally or by the owner’s agents at any time upon any building or premises where the unit may for the time being be housed and to break open by force if necessary any such building or premises, and the hirer agrees to indemnify the owner or the owner’s agents against any loss or damage suffered by them or any of them whilst exercising or attempting to exercise the rights conferred by this clause. On the owners repossessing the unit this agreement shall be deemed to be terminated, but without prejudice to any claim or demand the owner may have against the hirer in respect of any matter or thing prior to the date of such repossession.

    9. The hirer shall not be entitled to recover from the owner any sum for any delay, inconvenience or loss of any kind due to any accident, breakdown of defect in the unit or from any other cause whatsoever.

    10. The hirer is strictly liable for any loss or damage suffered to the unit and any loss or damage arising out of the hirer’s use of the unit or whilst it is in the hirer’s possession.

    11. Waiver by the owner of any breach of this agreement shall not constitute a waiver of any subsequent or continuing breach.

    12. Where the hirer is constituted by more than one person their liability hereunder shall be joint and several.

    13. The guarantor (and if more than one then jointly and severally) guarantees to the owner the due and punctual payment of all monies owing or which may become owing to the owner by the hirer on any account whatsoever pursuant to this agreement and further agrees to indemnify the owner and keep the owner indemnified from and against all losses costs and expenses which the owner may suffer or incur by reason of the default of the hirer in observing any of the obligations on the part of the hirer contained in this agreement.

    14. If for any reason the hirer does not pay any amount of money to the owner when it is due the hirer must pay interest calculated on the daily unpaid balances for the period the amount remains unpaid. Interest will be calculated at such a rate as the owner may notify the hirer in writing from time to time or if no such notification is given then at the rate calculated by adding 5% per annum to the Commonwealth Band Overdraft Index Rare (monthly charging cycle).

    15. In addition to the hire charge and any other consideration payable by the hirer to the owner under this agreement the hire must pay GST applicable on the supply of the unit by the owner to the hirer and upon demand by the owner to the hirer. The hirer must also pay all charges, taxes, stamp duty and other duties fines and penalties payable to any governmental body in respect of or arising as a result of this agreement.

    16. Where the hirer reports a mechanical or other fault or breakdown of the unit, the maintenance and repairs will be carried out by the owner at its expense during normal trading hours subject to:

      1. the hirer not being in breach of this agreement and all payments having been made in compliance with the terms of this agreement; and

      2. if the fault is attributable to the negligence of the hirer then the hirer will be charged for all costs associated with the repairs and other costs associated with rectifying such fault.

    17. Words importing gender shall include other genders and words importing number shall include both the singular and the plural.
